So carinsurance.net.au registrant has zero rights to .au?

Yes, because the .com.au is worth far more than the .net.au version. They have made a choice to buy a second rate extension, they shouldn't get a free upgrade at the expense of the .com.au owner. The rights of carinsuarance.net.au should be no different to the rights of bobsburgershop.net.au. Both have skimped or made bad choices.

Problem is that with the generic .com.au they were not available for reg until after .net.au and they were put to auction. The existing .net.au had an option of bidding so if they didn't their loss. You can't base ownership on who has it longest.

The only solution is for .com.au to get first option on .au no matter who owns the other extensions. .org.au .net.au .gov.au .id.au .csiro.au etc.
Even if it goes out to domain owners obviously there are 10x .com.au owners and they would all vote to have the .au given to them.

You can add another reason - they simply couldn't afford the com.au, which is why they went for second best. That shouldn't (and won't) allow them to be a player if and when .au rears its head.

Under NO CIRCUMSTANCES should rights go to who has the most money.

In this particular case, I think it is more likely that the .com.au simply wasn't available, because this .net.au owner could certainly afford it, even if they wanted seven figures.

Let's be realistic here, Deloitte is going to tell them it is a great idea for AUDA's revenue (which it is). I'll change my username to Pumpernickel Pie if Deloitte comes back and says there is no business case.

You might be surprised to hear Deloitte may have already advised auDA last week there is no business case for another competing .au extension. Deloitte have already said it in their own reports also.

I'd imagine that if the .com.au was put on the market it would go for a significantly higher amount.
33k was a loose change purchase, given the deep pockets of the buyer.

I remember auDA auctioned off the "reserved" generic .com.au names years ago and people paid a lot of money for them. Did they also auction off the .net.au and what wad the price differences if they did?

We will be going around in circles on this discussion until a decision is made but I can't see the problem with auctioning off conflicted names between conflicted registrants. The NZ domain name commission recognised that there's no hierarchy of rights so they came up with a solution which they thought was fair to all eligible registrants but unfortunately it doesn't appear to have been successful. Perhaps they misjudged the interest of registrants and thought that many of the conflicted holders wouldn't be interested in registering another extension but that has generally not been the case. Let's face it if you want the extension to be successful you can't totally exclude any conflicted names so the next best solution is an auction. Better still let's just leave things as they are because there's absolutely no need for another extension in the au space anyway.
