auDA to Cripple Business

Interesting video from Youtube, just posted yesterday,

Posted just today I think actually.

Jim Stewart got 2000 facebook views in the first 2 hours on this topic!

Thanks auDA for stuffing up the globally respected and trusted .au namespace!

Why does auDA wrongly think Australia need to be a follower of bad examples and failures overseas? The .uk and .nz both have failed. This is fact and even the DNC said it in their annual report people where dropping their shorter extensions and returning already to the .co.nz instead after just 1 year!!

It is time for new management at auDA or that they lost management of the .au namespace completely. Enough is enough before they bring the whole thing down and cost businesses a lot of money and jobs.

Good to see some people waking up...

If you where told by anyone at auDA, on the Board, on panels or in Supply that you would get the .au rights if you had a .com.au keep those records, sms, emails, recordings, posts etc! They will come in handy and you will have a claim to make.

If you deleted that data from your phone or emails, computer contact me and I can refer you to someone who may probably get it back.

https://www.domainer.com.au/a-timely-warning-for-au/

2015 /2016 Worst year ever for New Zealand domain name registrations and renewals. 1 year after direct .nz came in.....

https://www.dnc.org.nz/sites/default/files/2016-08/Domain Name Commission – Annual Report – .pdf

“The dip between February and March 2016 reflects the one-year anniversary of the end of the preferential registration and registration period – an important part of the registrations direct at the second level change. It appears that some registrants, having exercised their preferential registration rights, have subsequently let the shorter version of their name drop.”

Mr Swinson, chair of the PRP, specially talked about Jim’s video today at the Melbourne auDA meeting, very annoyed and suggested the video to be a load of rubbish.

You mean like his interview with Fran on the ABC?

Good work Jim.

They ask for feedback and get shitty when it's provided? Sounds like they are not really interested in what people have to say after all.

Yes the are not interested in feedback, they see the lottery as the “least worse idea” and because they can’t think of anything fair that is the proposal.

I believe they have been told to think up something no matter what and the main concern is “getting the job done” no matter the effect on business.

Hopefully the audio will be published, though don’t hold you breath, they even told people to stop who took photos of slides seemingly fearing they would become public.

https://stewartmedia.com.au/direct-au-registrations-update/

"I first posted about this here when I was running for the board elections. Now more information has come to light and it’s even more ridiculous. Thanks to Roberta Kaay and his article. Something I’ve learned since recording this video, is that if the domain registration happened after April 2016 you may very well have NO claim on it, regardless of trademarks.

Transcript
Are you a business owner do you own a domain name do you own a dot com dot au domain name a dot net dot au domain name. You may not realise it but AUDA is implementing what they are calling new direct au registrations that means in addition to dot-com dot au you’ll also be able to register just a dot au domain name. So in my instance I have stewartmedia.com.au I could also, when this is implemented have Stewart media dot au. Sounds good except that it’s useless it’s costly and I have no desire to have a dot AU and it’s confusing for the general public.

The main push behind this change has come from the registrar industry people who want to make money from selling domain names . So the problems associated with having direct au registration are many and the benefits are very very slim.

We’ve been told by the AUDA that there is a demand for this that we have to do this because people want it. We’ve seen no data to support that we’ve seen zero data to say that the Australian public need this direct registration. What it will in fact do is devalue your existing assets and so if I have stewartmedia.com.au it’s no longer worth as much because there’s also Stewart media dot au in the marketplace. People are confused about what the eligibility will be to have one of these direct au registrations and just most recently in the last week we’ve found out that if you registered an Australian domain name since April 2016 you will not automatically be eligible to get the dot au domain name. You will have to go into the Pool with everyone else who’s trying to buy that domain name.

So if you’ve established a business over the last two years with a dot com dot au you will now have to chase the dot au version of that domain name like everyone else and if you’ve paid a lot of money for your dot com dot au domain name because it’s a really good one you’re going to have to pay even more for the dot au when it comes out. In addition to that if two businesses have the same domain name but one’s on dotnet and the other one’s on dot-com dot au, so for instance you could have real estate dot net dot au and real estate dot com dot AUDA is saying those two businesses will have to work out who should have the domain name. And if they can’t decide it will go into a ballot a lottery. It will be a flip of the coin if you like to decide what happens to your business now.

I don’t know about you but I think that’s a terrible terrible idea and the other problem with these direct au registrations is that in other countries where they’ve tried it it hasn’t worked. In New Zealand they haven’t been taken up in the UK just even recently they were trying to give them away for free. Let’s be clear the only group that stands to benefit from a direct au registration is people selling direct au registrations and that’s not you and I. Please get on to AUDA.org.au and express your disappointment at this new domain."

It is good to see the message of "stop investing in .com.au" is spreading, this is absolutely the main thing people should be considering. auDA is broken, they are damaging this namespace. Stand aside until the knife hits the floor and it is safe to reenter, that could be long time as it is wreck in slow motion.

Any acquisition of a high quality name (drop or aftermarket) is dangerous right now because under the lottery model you are unlikely to get the .au without having to pay the owners of the .net.au, .id.au, .org.au etc.

Even if .au fails in the marketplace (highly likely over time) it is going to take a while for that to become apparent and many buyers just won't want one version without the other.

I question the validity of some statements and claims made here:

I think it is a clear conflict of interest to have done this and for Brett Fenton to on the PRP and making presentations to the Public with his very one sided viewpoint only from the podium.

Brett's position on the PRP totally invalidates the whole Panel and now we can see it is in many cases his suggestions coming through it seems from what Iread and saw in Sydney and Melbourne.

When called to produce facts... he had nothing...

https://www.netregistry.com.au/blog/vote-yes-to-opening-au-to-direct-registrations/

Brett this is also B.S. and you know it. Domainers are speaking out because only they know the facts ! We knew your blogs and Yes Only surveys where "rigged" to give only a Yes option and the template backs this up you provided.

Brett Fenton says

"The other area of resistance to the proposed change is from the 'domainer' community. Domainers buy domains purely to sell later at a profit, and monetise their domain portfolio through the traffic that arrives at the domain. You could say domainers have a vested interest in the discussion around opening up second level registrations as more choice in the marketplace could potentially make their existing .com.au domains less valuable."

Anyone who continues to register or renew any names with your company or associated companies in my opinion is crazy when this is your attitude... plus your prices are usually overpriced anyway compared to other registrars with a far better respect for their customers!

Brands are in trouble as well because they still will have to pay holders of the other extensions to get the matching name. What happens if realestate.au is allocated to the .net.au owner and a competing site (with a confusingly similar domain) starts up down the track? They can't risk that. Ditto for news.com.au and much of the biggest companies in Australia.

The only solution for these guys is going to to to pay up big money to protect their existing brand. The lottery won't be much different to an auction, it may even be more expensive as they'll be negotiating rather than bidding.

I don't think it will fly this time...

I think Brands and companies are better to start flooding legals letters to auDA and The Minister from their in house lawyers.

Why be blackmailed when it is so obvious this has been rigged. They would be better to band together and sue....or some are so big they could take auDA out of action completely if they wanted to.

I know REA Group has 7 full time in house lawyers alone.. How many companies on the ASX have in house lawyers...a lot!

If Narelle from the ACCC was there I assume this plan has already been ok'd by them. I'm curious if a final date for implementation was mentioned. as that video by Stewart Media was the first time that I've heard the April 2016 cut off date mentioned.

Had to laugh when Brett Fenton ( PRP Panel and Melbourne IT) at the Melbourne PRP meeting said from the podium he wanted the extra .au so he had the option to get BrettFenton.au

How about BrettFenton.com or BrettFenton.com.au or the other 1300 available domain name BrettFenton options all still now available Brett? No shortage of available extensions really is there to choose from?

I call B.S. sorry.

Narelle is not from the ACCC and NO the PRP suggestions are not ok or approved by Government, ACCC or ACCAN.

Narelle from ACCAN said they stand by their submission against and the press release which is attached again.

John Swinson ( auDA PRP) said he stands by his own submissions also still against .au. He however is trying to see what could work if anything as this is their very limited restricted role on the PRP as pushed by someone at auDA... See Attached.

Robert Kaay has mentioned Narelle Clark from Consumer Protection attended the Perth Meeting????
Accan.org.au is a not for profit government funded consumer organisation group. They are not the ACCC.gov.au

This is why having different domain names extensions helps people also. We have plenty of options already in Australia and besides these are are actually a lot more!

.gov.au for Government
.org.au for Organisations
.edu.au for Education
.asn.au for Association
etc.

If they all now want the direct .au how will you know where they are actually from to differentiate them?

Extensions where classed a certain way to help people. It works very well as it is.

That is pretty funny that brettfenton.com is still available given what he said.
