Does .au require a special resolution vote?

Does the direct registration proposal conflict with AUDA's constitution?

After Ned's resolutions and looking more at the "objects" part of AUDA's constitution I doubt AUDA has power to bring in .au under the current constitution which is drafted around 2nd level registrations.

Let's clarify what a 2nd level domain is

Domain.com.au - 2nd Level domain

Domain.au - Top level domain

The constitution states in the “objects” section,

d. to develop and establish a policy framework for the development and administration of the .au ccTLD including:

i. rules governing the operations of second level domain registries;

ii. the creation of second level domains;

iii. rules governing the accreditation of registrars and registry operators; (Amended by Special Resolution, 23 September 2002.)

iv. rules governing the registration of names within second level domains and access to second level domain registries;

v. ensuring that registrars have equal access to second level registry services.

e. to manage the operation of critical technical functions including:

i. the primary and secondary .au name servers;

ii. zone files for second level domains; and

https://www.auda.org.au/about-auda/our-org/constitution/#3.1

The constitution states AUDA's purpose is to develop policies around 2nd level domains, not top level domains, and the introduction of top level domains would likely require changes to the constitution in my view.

Snoopy you seem to know your stuff sometimes

Should this be added to the Resolutions? http://www.grumpy.com.au/petition/

Has anyone brought this officially to the attention of auDA, auDA Members, Department of Communications and the auDA Board?

Welcome to HQ the new home of .au
Feel free to browse our new constitution, and when finished, insert this microchip into your forehead.
Thank you for your cooperation.

Interesting to note on this that neither NZ or the UK had this issue of a constitution worded around 2nd level domains, seems to be unique to AUDA.

https://internetnz.nz/about/constitution

https://www.nominet.uk/about/corporate-governance/memorandum-and-articles/
That is because auDA has failed to actually make any progress. They could easily have changed the constitution and the majority would have agreed, 2 years ago. Now we have reached the point where they are scrabbling. I think they had plenty of "heads up" regarding the RTP.

The members are more annoyed at the fact that nothing ever gets done and decisions are not made.
It seems to me is that auDA's policy is that they ask stakeholders the question, we give our opinion and then they ignore it.

Let's not forget the Constitution states:
"ensuring its operations produce timely outputs which are relevant to the needs ofthe Australian Internet Community"

We are the community. Where are the timely outputs?
