renigging on sales agreement

Recently negotiated a price with a domain seller for a name they had been trying to sell. Offered a price they came back with a counter of what they wanted etc. After agreeing to their price they then took a few days and came back saying they changed their mind and where not selling domains at the moment. They then took the name off netfleet, changed their domain names monetised website ( parked with fabulous showing a buy now price)

The names still gone off netfleet but they have since updated their domains monetised page for sale price 3 x what they offered it and what we agreed to. We agreed on their sales price of $2700 now they want $10,000!

It's a shame to say these guys might even be members on this forum but of course we wont be naming them as its their right to change their mind and want more money...

Funny thing is it appeared the name sold a few years back on netfleet but actually it never did as they told us they had had it for 10 years. it makes that sale and the bidding questionable obviously...

Not a good look guys. If you set a price and the buyer agrees you might want to keep to your word or price you set and not suddenly get greedy jacking up the price looking for another buyer...

Yes it's there choice but it makes you question would you bother dealing with them again.

I presume from this that you didn't do the deal through Netfleet platform? That would have given you some legs to stand on perhaps.

it is good you raised this Domain Names it is happening more and more often

I regularly hear this from a lot of people, contracts can be formed by email, the problem is whether you want to start a court case for a $2000 domain, the answer is usually not....

That is one thing that makes domaining a very different industry than most, much of it relies on honour ............which is sadly lacking in our society sometimes

Go for the throat, Too many people still think emails/SMS deals have little validity.

They have now listed it again for sale on netfleet. It's received a very high opening "bid" at the same time as its been relisted.. Does this sound or look strange to anyone else? Out of decency I still wont say who they are or what the name is. Maybe they will come good .... ( They have now dropped their buy now price but.) its still 110% more than we agreed on as a sales agreeement before).

contacted them again via email to ask if they would honour the $2700 sales agreement. They replied they where not selling it any longer. 2 days later its back on netfleet !

Netfleet have confirmed same seller had it listed on netfleet 2 years ago and " sold it" then also. It then stayed on netfleet as that sale never apparently went through either back then. They did not inform netfleet.

The previous " sale price" was higher than their listed "buy now price" when we contacted them a few months back direct via email to offer to buy it as the netfleet system did not accept a bid as it was still in their system " sold" ... a bit technical but a bit obvious to see what the seller is doing or did. Their first email back to us said they will sell it for $3200 inct gst and fees. Via direct email we both agreed on $2700.

Should have made the offer on Netfleet - then there would have been a clear unambiguous agreement.... The public record would have been useful evidence if they decided to back out after agreeing.

The owner then delisted it and relisted it 2 days ago.

Yes 100% best to go via netfleet but in this case it was not possible.

Well surely Netfleet can now see this is an issue and should take some sort of action against them......banning would be a damn good start. :(

I sympathise with you, however as mentioned also in your support ticket - we really can't help you with any domain sales conducted outside of Netfleet, as it is outside of our control.

We were not aware that the original sale did not go through - this is the first we've heard of it.

I hope you manage to resolve the issue with the registrant

Snooks, this is not a Netfleet issue - the buyer and seller were not using Netfleet.com.au

Banning might be harsh - depending how you look at it - but buyers and sellers should be able to develop a reputation on NF so people don't waste time with shonky sellers and tyre kicking buyers, and it gives everyone incentive to act with integrity.

I dont see why banning is harsh Chris :( This guy is playing games, hes being unethical, hes telling lies and frankly, if you cant be trusted to show some integrity you shouldnt have the privelage of being allowed to list domains on there.

Snooks, I think you're misunderstanding. The dealings between the buyer and seller had nothing to do with Netfleet...it was some private deal they were doing, and had no connection with NF. We can help when business is conducted using our platform, if not, we can't.
