.Com.Au has far more mindshare than any other .AU SLD. A simple survey of the public should confirm this.

Agree, but AUDA isn't going to listen to this, they want some technical/academic reasons as to why .com.au would get preference.
The "common sense" arguments tend to by ignored. So they'll say .id.au owners have just as much rights as .com.au owners and we'll likely end up in auction scenarios in .au ever happens at all.
"We couldn't work out any fair way of deciding rights so we must have an auction".

Yeah the blind adherence to the principle of no hierarchy of rights needs to be laughed out of it's entrenched position.

It's just nothing more than a revenue push... there will be plenty of folks that benefit from rules no matter which way they offer first right to purchase. My worry is that many great domains will be locked up with owners having no intention of using, as I saw the new domains being an opportunity for many folks to secure some decent EMDs

Agree. This kind of release isn't going to increase development. I remember years ago with AUDA's generic auctions very few domains were being developed (of the names I watched) despite them being high quality names. A lot just went to corporates as defensive reges to prevent others using them.
For .au it will be far worse because there will be a low incentive to develop due to confusion issues. It is comparable to a new tld release.

After the AGM and Luke's question about has AUDA received legal advice to which the answer from AUDA seemed to be "no", I have been thinking more about this (see youtube link below @ 1:28 minute mark)
I think if .com.au owners are not guaranteed rights then is more likely to lead to lawsuits, e.g. if you get the scenario of realestate.net.au having equal rights to realestate.com.au and some kind of random chance draw is proposed, gumtree.id.au and gumtree.com.au, news.com.au and news.org.au.
I would say a decent chunk of Australia's biggest companies are going to have this issue. Surely this is going to lead to many lawsuits or potentially class action lawsuits. (it was suggested in the audio that people are already known to be considering actions) If AUDA loses where does that put the organisation given they have maybe $14 million in the bank and they are likely to be up against a whole lot of multi billion dollar companies?

How about auDA goes back a step and auDA contacts every single registrant of an .au domain name and gives them the opportunity to “have a say” about introducing direct registrations with full facts as to costs and implications?

- However, we do realise that there are some who have a different point of view to ourselves. Those that are in favour of direct registration. To them we say this. We respect your point of view – but we’d hope you’d agree and believe in proper process being followed. Our consistent position is that if auDA contacts every single registrant of an .au domain name and gives them the opportunity to “have a say” about introducing direct registrations (with full facts as to costs and implications), then we will accept the majority view.
