What to do if an new owner will not process COR

What would you do now?
A person paid me $1000 for a name a year ago
I sent the buyer a Change of Registrant form and the Password
They did nothing
I sent 6 more messages over the course of the year and the buyer responded to every one saying they will do the transfer soon
The last message I sent warned that the name was set to expire in my account
I got the same response, that they would do it soon. Not an auto reply, I mean words to that effect
It expired 2 weeks ago
I renewed on the last day
Would it be fair enough to sell the name for $2k to someone else and refund the old buyer the $1k
I suspect not
What would you do?

Maybe you can put a deadline on when they need to do the change of reg
and pointing out if they dont do it by that date you will be refunding them their money and keeping the domain name as you have given them many chances already.

I have a similar situation to you Gran, except not that long (3 months maybe). I have been thinking recently that I may put a deadline on it, and if they don't get the COR done in X time then the sale is off, and they forfeit the money they paid. I mean, 1 year is MOOOORE than long enough.

I wouldn't refund at all. If it would have expired, they would have lost it. Tough titties.

Yeah its a tough one as Timmy has point out, had you not renewed it for them it may well have proceeded to auction where someone including yourself could have registered it.

With that said as the domain had never been transferred out of your account I guess they may have had some legal hold on a refund as the good had never been 'picked up' yet.

Depending upon your registrar you should be able to create a new profile (of course initially with your ABN details) and have the domain moved to that login. You could then have changed the contact email address to them, making them completely responsible for the domain (while continuing to chase them about transfer of ownership).

I would have done as you did and renew it out of good faith, but this now raises the addition question of 'will they reimburse you for the renewal? I'd contact them again advising of the situation and ask him if he still wants the domain. If you feel you could possible get 2k for it now then it may be better for you if the other party would like a refund anyway.

Overall I just can't believe someone would pay $1000 and not want to immediately transfer it into their own account. The $79 or so transfer fee would seem a minor amount to ensure you get your purchase.

domainlover you are dreaming if you think i sold grandma should REFUND , he has sold the domain in good faith and if the buyer is too lazy or unwanting to do anything with it , that is not i sold grandma's fault , he has done the correct thingby renewal and still being able to pass it on

It does seem a phonecall is in order to achieve some form of result , and in the future perhaps we should all stipulate a transfer period , after which we retain ownership if the domain is renewed ?

If you put a deposit on a house and then dont follow through do you get your money back ?

Make the phonecall and settle it one way or the other i suggest

spacey who do you think is the owner of the domain name ? i dont think it is that clearcut to just say bad luck pal,was any time limit put on the buyer initially ? prob not, so it is murky waters.

as stated a clause should go in all sales

I only just settled on a couple of domains today that I paid for a few months ago. I hadn't realised it wasn't sorted (in this case both parties had filled out the forms but the registrar transfer hadn't taken place) so I know from experience that this sort of thing can easily happen.

Of course here grandma's been bugging the guy so he's really got no excuse - I say tough luck (unless it's me... it's not is it, Joe?!)

It would still be my account. I don't see why I have to keep chasing them now.
You have reminded me that I can change all the details except the ABN . Thanks. I might do that and tell the buyer I am going to charge for the renewal and maintenance
I have had several people do this , buy a name ,and then not pay for the COR ,so it remains my name. The other names were of less value , around $200
A couple the of people who took months to process a COR are on this board!
This is one surprises me though because the person concerned is well aware of COR , having bought several other names from me.
I am just so tempted to transfer it to another registrar and sell it, and then refund the buyer. I am sure that is NOT the right thing to do though. I am just tempted.
If I had not renewed it , it would have dropped and definitely sold at auction for more than $1k
No way am I going to refund before selling
I think this just proves what a stupid change of registrant process we have
Filling out forms for internet based services
The COR system just does not work efficiently
Registrars charging up to $220
Every form is different
One registrar makes me send my photo id to the buyer!!
My favourite registrar charges less than $50 for COR

Compare it to the dot com push system operated by enom or Fabulous
Names sold and paid for.Bang! It is in the buyers account within seconds

lessons to be learned there , i did read a post from the original seller at namepros , he never mentioned he had renegged on a previous deal ?
