Hi guys just looking for some guidance in regards to registering trademarks for the sole purpose of a review site (yes the reviews will be bad) though their will be no third party affiliation involved.

Can we do this ?

Regards.

not sure, i think there's some scope for "consumer advocacy" sites to include TM terms in a domain, like "trademarksucks.com" and whatnot but I don't know how that flies when it comes to .au

almost certain you can't monetise names like that in any way so why bother? if it's just for revenge then either a) get over it and spend your time on something worthwhile (highly recommended) or b) cause them rep mgmt headaches in more creative ways

auDA would have no problems with the site. The trademark owner may have a go but depends on the content whether they will be successful. They would have to prove 'bad faith' intent amongst other things.

We successfully defended an auDRP against HoldenDiscounts.com.au for comparison's sake

Okay so if we want to solely own the domain for others to post their reviews (consumers of the competitors product) it's fine as long as we don't attack the brand & as long as we don't monetize the site ?

Also the website won't be used for revenge it will rather be used to channel the traffic to another website.

Regards.
