Hi

I recently been in contact with Glen from Thredbonet Marketing and while I noticed my facebook page went down fb.com/Thredbo. They are the owners of the domain and are being sued for the use of the town name which Kosciosko Thredbo Pty Ltd are arguing that they own the word Thredbo even though it is gazetted as a town name.

I shot coopers Lawyers an email today but would like to know if anyone has encountered something similar.

Looks as though this is a Trade Practices Act (Misleading Conduct) and not a trademark case.

The guy actually has a legitimate local business renting properties out on behalf of the owners and been in business for a long time. I think if this case succeeds there can be trademarks setup over other townships and cities which will hinder any legitimate use of the trademarked town name.

if you have time look at:

byronbay
byron bay
byron-bay

there are multiple businesses, domains, companies and a few trademarks but this type of thing doesn't seem to happen with byron bay? research that the byron bay council tried to trademark the name and failed.

echo.net.au is the local newspaper and report EVERYTHING, they have a very good database.

what i'm trying to say is there may be a precedence that you can use especially as its in the same state.

this might be useless info but i thought its all i can offer on the legal issue.
