Scam merchants indeed. But unfortunately they are very smart - technically not doing anything illegal. Just relying on the gullibility of some.

According to their T & C's, they are resellers for TPP Wholesale.

just to recap, their address is serviced offices in Melbourne which I went to ( just for fun) and the girl at reception had to check to see
she told me I had to book an appointment but they hadn't been there in 6 months.
I'm sick of them wasting my clients time and sometimes money. problem is it is only us that will read these articles.

problem is their letters are legal, its just that businesses don't read them correctly.
auda isn't responsible but maybe should take a harder line once these scams are SOOOOO prominent.
to speak out as i do because that is the only way change may happen if people speak out, then if i was auda its pretty simple, if you get enough complaints from these scams then track down the registra and TELL THEM to close their account, and THEN keep doing it.
auda gets a % of domain name registration but nothing on .com's ( i think) many of the letters my clients have received are to do with the .com BUT the information to send the email is auda based so the ball does fall back into their court IMHO.
if they are running it via TPP, then threaten them with some form of ban, auda isn't responsible but needs to be pro active.
this has been going on for years so it really is an embarrassment to auda.

auDA did do something about a similar scheme years ago - I believe they took the matter to the Federal Court. http://www.auda.org.au/about-auda/our-services/consumer-alerts/alert-domain-names-australia-pty-ltd/
One of the perps subsequently declared bankruptcy.
But like so many scams, they "phoenixed" the operation with slight variations (so as to be more compliant). I understand that a brother of the original perp became the front man, and then some other mates.
Josh Rowe (current director of auDA) seemed to do a good job of tracking them down (and associating them) http://dotau.org/archive/2003-09/0257.html (It is a long thread, but worth a read).
The current director of Domain Register Pty Ltd is mentioned in Josh's post - Craig O.
Whilst their current email and "look-alike invoice" may be misleading and deceptive to some, they seem to have dotted their "i's and crossed their t's" with regards legality.
It simply states "Domain Name Available". And then in very small print it says:
Must be a successful business model for them.
