Disappointing Decision

A few weeks ago, I wrote about a pending auDRP decision on the 3L domain HRA.com.au.

That decision has been handed down, and the sole panelist ruled against the domain registrant. Terrible decision in my opinion, however the respondent did himself no favours by not submitting a response.

There are some big lessons in this for domainers who simply use parked pages.

this issue of the computer posting ads not being able to be controlled, filtered is a BIG one.

Do you think the result would have been the same if they responded?
Not necessarily. There have been a number of 3L .com domain disputes that have been successfully defended.

However, as I said originally, he didn't help himself in the first instance by not having his links on his parking page sorted out. And then combining that with "no response" certainly made it easier for a panelist to give a negative decision.

Complainant has to succeed on all three legs of the auDRP. The third leg is "bad faith". How could the respondent have registered that domain in "bad faith"? That's where most successful defences have been won.

I don't think there is much surprise in that decision. Domain previously lost in a dispute and the owner hasn't responded. These aren't clear cut domains like a one word .com.au often would be, they need to respond as the basic facts don't look so great.
