Came across this via David Goldstein's newsletter. Certainly an interesting one:

Company that uses AGL.com.au wants AGL.com.

Australian natural gas and electricity company AGL Energy Limited has filed a UDRP against the three letter domain name AGL.com.

The company uses the Australian country code domain name AGL.com.au for its website.

AGL.com was originally registered in 1999. The current whois record has privacy, but taking a look at historical whois records from DomainTools, it is possible that the current owner acquired the domain name in 2004.

Given the what is on the park page I'd say the domain owners chance of winning are on the lower side. He'll need a very good lawyer who can dig him out of the hole he has dug and a lot of luck, without that it is a slam dunk for AGL. Even has an Australian (privacy protect) address on whois.

Snoopy is it the fact it was only parked that will let him down? If he had a site on the domain, he would have a better case?

The issue is the advertising on the domain. If it was a site about something other than Australian Gas Light or their products/services it would likely be fine. If it is a site about Australian Gas Light and/or gas a electricity it is likely to be lost.

I wonder if AGL has offered the domain holder money for the domain, would be interesting to know, probably impossible to know.

But yeah running ads for AGL.com.au on the parked domain is dangerous that is for sure.

Agl.com appears to be redirecting to another site now. What's the deal if he has already sold the domain? Agl dispute gets thrown out and they have to start over ?


Also what were the ads ? Adsense/sedo etc ?

not at all, if an auDRP has been filed then the domain is locked, it doesn't matter that it may have been subsequently sold. That is why it pays to do a whois on a domain before buying, and always do a bit of basic research and due diligence
 
I also recall AGL having run a UDRP or auDRP not to long ago on another domain. Some registrants are their own worst enemies, as they do stupid things with domains and then an auDRP is easy.

I think I read that this dispute had already been resolved in favour of the domain name holder in March.

Agreed, i thought this was old news as i also had read about it via domaing.com a while ago, with the main point being Agl we Australian Gas and Light for quite a while
