Domain name policy

Thank you for your email to the Hon Malcolm Turnbull, Minister for Communications, regarding potential changes to .au domain policy. The Minister has asked me to respond on his behalf.

Your email raises a number of issues, however I understand that your key concern is the potential for direct second-level registrations to become available in the .au name space. As you are aware, this is an issue being considered by the 2015 Names Policy Panel that has been established by the .au Domain Administration (auDA).

auDA is the industry self-regulatory body responsible for the management of the .au namespace. auDA is an independent organisation that is not part of the Australian Government. auDA has an agreement with AusRegistry Ltd to perform back-end registry services for the .au domain, which expires on 30 June 2018. AusRegistry was appointed through open tender processes held in 2001 and 2005, and subsequent licence extensions in 2009 and 2013. In July 2015, AusRegistry was acquired by Neustar Inc. The acquisition does not impact on the contract for back-end registry services.

auDA is responsible for setting and enforcing policies relating to .au domain names, and from time to time these policies are updated. The Names Policy Panel was established in December 2014 to review the policy framework underlying the allocation and use of domain names in the .au domain space, and provide recommendations to the auDA Board. Panel members were appointed on the basis of their individual skills, experience and knowledge, and were deliberately chosen to represent a fair balance of stakeholder interests. The 2015 Panel is comprised of members from key stakeholders groups, including industry, business, consumer groups, government, and academia.

In May 2015, the Panel released a discussion paper, which was followed in August 2015 by its draft recommendations. The Panel is seeking public comments on its draft recommendations until 30 September 2015. Following this second phase of consultation, the Panel will provide its final recommendations to the auDA Board. This is expected to occur by the end 2015. The Board will consider the recommendations and make a decision on whether or not to implement them.

The concerns you raised in your email are being considered by the Names Policy Panel. I would encourage you to make a submission via auDA's website at http://www.auda.org.au/policies/paand-committees/2015-names-policy-panel if you would like the Panel to consider your views.

Yeah that's what Adrian said at the meeting too. Hang on are you pointing out direct registrations or all .au?

The issues are;
1. Direct Registrations - Why is it progressing and who is pushing it at auDA, auDA Board or Supply? ( Wholesale registry Ausregistry etc obviously).
2. Why has auDA and Ausregistry not reduced wholesale .au pricing as promised in 2008 as part of the contract renewal terms?
3. Is Ausregistry ( or related people/ entities) behind the scenes causing "havoc" on the auDA plans to run the Wholesale Registry?
4. Has auDA and the auDA Board failed in their duty to enforce the 2008 Contract renewal terms which required wholesale pricing " further drops as volumes increase."
5. Are there Conflicts of Interest having the Wholesale Registry Contractor on the auDA Board and on auDA risk and other auDA Committees?

c. the promotion of competition in the provision of domain name services;
d. the promotion of fair trading;
e. the promotion of consumer protection;
f. adopting open and transparent procedures which are inclusive of all parties having an interest in use of the domain name system in Australia;

g. ensuring its operations produce timely outputs which are relevant to the needs of the Australian Internet Community.​

So why no further drops for the wholesale.au pricing since the volumes increased after 2008?

It raises a lot more questions....and concerns about what has been going on.

We are talking massive amounts of money..$$$,

I expect the media will continue to investigate now....Good job 2GB and Josh Rowe for getting the ball rolling.. without that story auDA would not have moved so fast last week.
