I have a US based company who want to buy a domain off me. They've asked me what is the best way to go about it as they have no ABN.
Anyone had this issue before who can can offer advice? They have no TM on the term.

I thought I read somewhere if they apply for the trademark they can then have the domain name under that rule without an abn.

Okay DNtrade member has let me know how they can do it. Knew I'd get the answer from here. The trademark idea was it.

For those wanting to know how it can be done, I suggested to the buyer to regiater a trademark for the term which should cost $1500 approx. Under the auda policy which I've pasted below even allows for those waiting for trademark approval.

"To be eligible for a domain name in the com.au 2LD, registrants must be:
a) an Australian registered company; or
b) trading under a registered business name in any Australian State or Territory; or
c) an Australian partnership or sole trader; or
d) a foreign company licensed to trade in Australia; or
e) an owner of an Australian Registered Trade Mark; or
f) an applicant for an Australian Registered Trade Mark; or
g) an association incorporated in any Australian State or Territory; or
h) an Australian commercial statutory body."

Keep in mind they will also need a lawyer to act as a local agent, usually the same people that act as the "address for service" for the Trademark
