Ok just got it for a client that was starting a warehouse storage facility. Also realised I put it in the wrong forum title as I posted other of my own domains previously. I was meant to post in web development. Sorry for misunderstanding and thanks.
 
Would think the chance of AUDA intervening is high.

The storage stuff sounds like bulldust, would not expect AUDA to allow you to keep on the basis of saying that to them.

Chris, I don't know whether you're reasonably new to acquiring Aussie domains?

Let's assume you are - so rather than castigate you, may I please give you a few constructive suggestions?


  • As Demonoid said, you (not your client) are blatantly infringing on a well known trademark.

  • You need to act quickly and remedy the situation. It's easy to do - just contact your registrar (Netfleet) and ask them to delete the domain.

  • It's better you get in first and do it before anyone else gets involved. If you don't; and you receive an auDA complaint, you will potentially be faced with a complete audit of your domain portfolio. And that's not nice. (Some people equate it to an enema! ;) )

Why would you ask for a appraisal on the domain if you purchased it on behalf of a client.

This domain is a well known established brand, and now that Myspace is owns by a Media company and a few stars they are probably sitting around looking for things to like take action on domains like this.

I would delete and move on.
 
I actually think it's a great name for storage units and wouldn't step on the trademark. I'm sure you could look at applying for your own trademark also and the sooner the better I guess.

I'm surprised at your support for the use of this domain. Aren't you the person who likes to complain to auDA when you think someone is "squatting"? :eek:

I mean this is what you recently said about Perth.com.au when you were challenged (as to why you had complained):

To draw attention to the possible squatting of course. In my opinion it's not uncommon to find a questionable registrant on many domain names that I search for. I think those that wish to play outside the rules should be penalised for it.

Just as an aside, another helpful tip when deciding if something is "iffy" is to look at auDA's List of Prohibited Misspellings

A quick check shows these three domains on the list - thus telling anyone that there is a potential problem.

A single complaint Ned! If this domain is used for storage as described I can't see any problem whatsoever. It's no different to any word that can be used for different goods and services particularly if they apply for a trademark.

You may technically be correct Horshack.

But all I'm trying to do is save Chris from potential grief (or at least alert him to it).

It's not nice to get on auDA's radar in a negative way; nor is it productive to cop an auDRP complaint. The time and effort that would be involved in defending (and winning) this particular situation would simply not be worth it. Imho.

It is not being used for that purpose. No point talking about "If". Might as well say..."if" myspace did not exist, or "if" auda's rules were different.

That's not a bad way to look at it, trademarks come under the heading of different categories so it could very well be worth looking into, having said that i do remember when Virgin hit town and tried bully everyone that the word 'virgin" in their business name
