I wonder who targeted Jim? ... Lot's of rumours and opinions who did it and questions about the process followed.. I am sure they will be exposed.

What role did auDA play in this?

Was there any Board involvement at all? Did they discuss this at any Board meetings?

Let's wait to see if it is on the auDA Agenda and Minutes....

Strange timing?

"About Jim Stewart

Jim has been working in the Australian Internet industry since the mid 90s. For the last 19 years he has owned and ran StewArt Media and digital agency based in Melbourne that currently employs 25 people and services businesses nationally & internationally. They specialise in search & display marketing supported by conversion optimisation & content creation.

Jim is a prolific marketing speaker both here and overseas and has graced the stage at some of the largest digital marketing conferences including Retail Global and Pubcon. Jim is a proponent for the next evolution of search marketing, one that places an emphasis on building your brand over the antiquated notion that “tricks” will increase business growth

He pioneered streaming media in Australia with the first live webcast from Antartica in 1998 and the building of Australia’s 1st Internet radio stations in the following year. He has helped thousands of business owners over the last 25 years do business online.

He has appeared on several television shows such as The Panel, Sky News and A Current Affair discussing business related Internet issues.

Jim is passionate about a free & open Internet and lobbied hard against censorship proposals from both the federal liberal Government in 1998 and the ALP Government in 2008."

"auDA today acknowledges the decision of the independent Registrant Review Panel (RRP), in regards to stewartmedia.com.au. A copy of the RRP Decision can be found here.

auDA is currently examining the RRP finding to identify whether any changes are required to existing policies."

So auDA got it wrong and seem to be implying there was something wrong with the decision or are they just embarrassed they don't know the rules?

Maybe auDA should pay the costs?

Was there no other way to solve this than what Jim Stewart was dragged through?

Amazing timing looks very bad for auDA.

Maybe Jim Stewart could present this case at the SGM meeting to let members know what happened and how members feel about it?

He'd likely need to take legal action to recover his costs against them beyond the existing order for auDA to refund application fees, perhaps in the Federal Court of Australia as that seems to be auDA's flavour of the day?

Maybe he can present this to the court now as evidence and it might raise some red flags to the Court..

Certainly it seems to show some issues with current auDA process and management possibly assisting the SGM and resolutions?

Did auDA discuss this case at any auDA Board meetings and choose to go hard again Jim Stewart instead of using the other way which would have fixed the issue within policy and without legal costs for anyone? That could further highlights auDA Management and Board serious issues it seems..

David and Goliath battle which will make global IP and Domain news as auDA now has a serious stain losing and how it may have been handled better, faster, cheaper and without them losing reputational damage.

Some more news about this here,

“It’s significant, it will be well over $100,000.”
Stewart suspects the complaint against the domain came from a stakeholder who supported the policy idea of direct “.au” registrations. Last week, auDA announced it will putting discussions of these plans on hold until next year at the earliest.

This is a ridiculous situation where auDA can close down any business running on a .au address with massive costs if business wants to fight it, especially when the motivation is based around auDA politics,

"Stewart suspects the complaint against the domain came from a stakeholder who supported the policy idea of direct “.au” registrations."

Who could it have been?.. Lots of rumours all seemingly pointing the fingers at the same party.

Will someone leak details who lodged the complaint I wonder?
I think the Government, those reviewing auDA and other people/ parties will be looking further into this!

I wonder if when Jim files for costs he can do some legal "discovery" or if other Government departments look into this further they will find out without doubt who was linked to the complaints and targeting?

Even if Jim does not pursue it against the person who lodged the complaint I think the Government review will have to now it is in the mainstream media and the costs Jim and others have suffered from the targeting. Government has oversight responsibility to investigate.
