This might be slightly off the topic, but in regards to good and bad links, should Google seriously be penalising websites for incoming links?

I can imagine a scenario where a webmaster decides that instead of gaining quality links (a time intensive and expensive task), they employ groups of people to blindly submit all their competitor website URLs to dodgy link farms and unethical directory sites to cause those websites to be penalised.

I know Google has a "disavow links" tool, but this requires the webmaster to keep regularly abreast of links to their site appearing on the web.

This can happen it is called Negative SEO, it is a key reason why you have to monitor your websites link profile too see what is happening on a daily and weekly basis. If some suspicious occurs attend to remove the links via out reach first and use the disavow tool as a last resort if you can not take down the links.
